The present day sponsorship system places a sizeable and daunting legal responsibility on employers for the immigration control of its non EU migrant workers.

Sponsor licensing is complex and tightly regulated legal permission to employ, or ‘sponsor’ skilled non EU migrants. Increasing controls and limitations have made a sponsor licence much more difficult to obtain, and very limiting as a means of staffing your business. Sponsorship should not be viewed as a primary route to fulfilling your staffing needs.

Are you eligible for a Tier 2 Sponsor Licence?

Your business must meet stringent criteria to justify a sponsor licence. The government’s drive to reduce dependency on non EU workers means exhaustive efforts must be made to recruit a British / EU national, or a settled worker before a job is offered to a migrant. This is known as Resident Labour Market Test (RLMT). It is not enough to advertise the post for 28 days before assigning a Certificate of Sponsorship (CoS). A thorough recruitment process must be carried out with detailed evidence retained for inspection. Failure to do so is a breach of sponsor rules and will lead to licence revocation or refusal if applying for a new licence.

The size, scale and nature of your business as well as the job roles will also be a determining factor in granting you a licence. In addition Home Office apply rigorous ‘genuineness’ testing to determine the credibility of jobs you have filled or intend filling under Tier 2 sponsorship.

Please note sponsorship is restricted to commercial ‘graduate level’ occupations not typically found in a restaurant operation. There are exceptions however in the case of Chefs that meet ‘shortage occupation’ criteria.
